The focus of this year’s program will be a “back to the basics” of the Illinois Uniform Commercial Code.  A majority of the program will be a review of court opinions, fact patterns, and examples.  The facts, backgrounds, and rulings from these cases and opinions will be discussed in an effort to help lenders identify potential problems and risks when assessing, underwriting, and handling loans. 

This program is designed for lenders working with agricultural borrowers and will concentrate on the special risk assessment and management techniques that arise in today’s agricultural loan settings. The ultimate goal is to provide a better understanding of the scope and application of the Illinois Uniform Commercial Code and to provide alternatives and options for avoiding the pitfalls to documentation and perfection that have been identified by court opinions.

Objectives
At the conclusion of this seminar, participants should be able to:

  • More fully understand the UCC and its purpose and process
  • Better identify and evaluate the unusual risks associated with agricultural lending
  • Determine proper method for perfecting liens on collateral
  • Better protect the lender’s position at the outset of the transaction

Presenter
Jeff Mollet is an attorney at Silver Lake Group, Ltd. in Highland, Illinois where his present focus is banking and finance, real estate, and agriculture. He represents numerous financial institutions providing support for general and complex loan transactions, employment matters, secured transactions, and commercial litigation. He also provides representation in bankruptcy matters and advises and counsels clients with respect to loan workouts and general business and operational issues.
